1. Acceptance of Terms
By accessing or using AImonitor ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
AImonitor provides AI API monitoring, analytics, semantic caching, and cost optimization services. We act as a proxy layer between your applications and AI providers, enabling real-time tracking, budgeting, and optimization of AI-related expenditures.
3. Account Registration
To use certain features of the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your password and API keys
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe upon intellectual property rights of others
- Transmit malicious code, viruses, or harmful data
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service or servers
- Resell or redistribute the Service without authorization
- Use the Service for competitive analysis without consent
5. Billing and Payments
Paid subscriptions are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for all fees incurred. Prices are subject to change with 30 days notice. Refunds are provided according to our refund policy. Failure to pay may result in suspension or termination of your account.
6. Intellectual Property
The Service and its original content, features, and functionality are owned by AImonitor and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of your data and content processed through the Service.
7. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. You grant us a limited license to process your data solely for the purpose of providing the Service. We do not sell your data to third parties or use your API request content for training AI models.
8. Service Level Agreement
For paid plans, we commit to 99.9% uptime for our proxy services. Downtime excludes scheduled maintenance, force majeure events, and issues caused by third-party providers. Service credits are available for eligible downtime according to your subscription plan.
9. Limitation of Liability
To the maximum extent permitted by law, AImonitor shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses resulting from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free. AI cost savings and optimization results may vary based on usage patterns and are not guaranteed.
11. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately. You may export your data before termination according to your subscription plan features.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
